CFA Institute Member Marketing Materials Legal Terms and Conditions of Use

These terms and conditions (the "terms and conditions") incorporate by reference and supplement the CFA Institute Legal Terms and Conditions of Use, available here, and apply to your use of the CFA Institute Member Marketing Materials (the "Marketing Materials") as a registered user (“User”, “you”, “your”). These Marketing Materials have been created by CFA Institute ("we") for the purpose of assisting third party firms and individual charterholder members ("Firms") who may wish to use them for marketing purposes. 

Firms are solely responsible for their use of the Marketing Materials. CFA Institute is not an entity regulated by certain regulations that may apply to Firms, and is not responsible for ensuring Firms' compliance with all relevant laws and regulations.

 

Use of Marketing Materials

We reserve the right to deny Users access to the Marketing Materials or any part of it without notice and to decline to provide access or services to any User who is in breach of these terms and conditions.

You agree to comply with all laws, rules and regulations (e.g., national/federal, state, local and provincial) applicable to your use of the Marketing Materials. The CFA Institute Legal Terms and Conditions of Use are hereby modified for the purposes of using these Marketing Materials to allow Users to post, submit, access, disseminate, store, or add a firm name and logo (where applicable) to the Marketing Materials.

Note:
 
Many investment managers and firms are subject to the Securities and Exchange Commission’s regulations, including the Investment Advisers Act of 1940 (“IAA”).  The SEC interprets and enforces the provisions of the IAA, including advertising and social media restrictions for SEC-regulated individuals and firms.

Before you use the advertising assets provided, whether for advertising or for use in social media, consult with your compliance or legal department to be sure that these materials comply with the IAA.

Liability

Additionally, we do not make any representations about the legal impact of Firms' use of these Marketing Materials. While we reserve the right in our sole discretion to remove the Marketing Materials from time to time, we do not assume any obligation to do so and, to the extent permitted by law, disclaim any liability for failing to take any such action.
